I. INTRODUCTORY PROVISIONS

1. These Terms and Conditions (hereinafter the “Terms and Conditions”) of the company Rawbark s.r.o., with its registered office at Slaměníkova 27, 614 00 Brno, identification number (IČO): 09415629, registered in the Commercial Register kept by the Regional Court in Brno, Section C, Insert 118939 (hereinafter the “seller”), govern, in accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter also the “Civil Code”), the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract (hereinafter the “purchase contract”) concluded between the seller and another person (hereinafter the “buyer”) through the seller’s online shop. The online shop is operated by the seller on the website located at the web address www.rawbark.cz (hereinafter the “website”), via the website interface (hereinafter the “shop web interface”).

2. These Terms and Conditions have been drawn up in accordance with Act No.  89/2012 Coll., the Civil Code, as amended, and in accordance with Act No. 634/1992 Coll., on  Consumer Protection, as amended, and do not apply to cases where the person intending to  purchase goods from the seller is a legal entity or a person acting, when ordering  goods, in the course of their business activity or independent profession. For the  purposes of these Terms and Conditions, the buyer means a consumer within the meaning  of Section 419 of the Civil Code (i.e. “A consumer is any natural person who, outside  the scope of their business activity or independent profession, enters into a  contract with a business or otherwise deals with it.”)

3. The provisions of the Terms and Conditions form an integral part of the purchase  contract. Provisions deviating from the Terms and Conditions may be agreed in the purchase contract,  in which case such deviating arrangements in the purchase contract take precedence over  the provisions of the Terms and Conditions. Relations not governed by the purchase  contract and the Terms and Conditions are governed by the legal order of the Czech Republic, in  particular by Act No. 89/2012 Coll., the Civil Code, as amended, and Act No. 634/1992 Coll., on Consumer  Protection, as amended.

4. The seller may amend or supplement the wording of the Terms and Conditions. This provision  does not affect rights and obligations arising during the period of effect of the previous wording  of the Terms and Conditions. The seller will publish information on any amendment or supplement to  the Terms and Conditions on its website without undue delay after the relevant amendment or supplement  has been adopted.

5. By making a purchase through the e-shop, the buyer consents to the use of means of distance  communication when concluding the purchase contract, as it would otherwise not be possible to  establish the mutual contractual relationship.

II. USER ACCOUNT

1. Based on the buyer’s registration on the website, the buyer may access  their user interface. From their user interface the buyer may  order goods without having to re-enter their personal details (hereinafter  the “user account”). Where the shop web interface allows it, the buyer  may also order goods without registration directly from the shop web  interface.

2. When registering on the website and when ordering goods, the buyer is obliged  to provide all details correctly and truthfully. The buyer is obliged to update the  details given in the user account whenever they change. The details provided by the  buyer in the user account and when ordering goods are deemed correct by the seller,  and the seller bears no liability for any damage caused to the buyer as a result  of incorrect or untrue details.

3. Access to the user account is secured by a username and password. The buyer is  obliged to maintain confidentiality regarding the information necessary to access  their user account and is not entitled to allow third parties to use the user account. The  seller bears no liability for any damage caused to the buyer as a result of a breach  of the confidentiality obligation or as a result of the user account being made accessible  to a third party.

4. When ordering the “Tailor-made dog food” product, the buyer fills in a form containing specific details that the seller will use to prepare the “Tailor-made dog food” according to the buyer’s personal requirements. If the buyer has provided the seller with a photograph of their dog, the buyer consents to the use of this photograph on the packaging of the “Tailor-made dog food” they have ordered.

5. The buyer acknowledges that the user account may not be available continuously,  in particular due to necessary maintenance of the seller’s hardware  and software, or necessary maintenance of the hardware and software of third parties.

III. CONCLUSION OF THE PURCHASE CONTRACT

1. The shop web interface contains a list of goods offered for sale by the seller,  including the prices of the individual goods offered. The prices of the goods offered  are stated including value added tax and all related charges. The offer for sale of  goods and the prices of those goods remain valid for as long as they are displayed in  the shop web interface. This provision does not limit the seller’s ability to  conclude a purchase contract on individually agreed terms. All offers for the sale of goods  placed in the shop web interface are non-binding and the seller is not obliged to  conclude a purchase contract regarding those goods.

2. The shop web interface also contains information on the costs associated with packaging  and delivery of the goods. The information on the costs associated with packaging and delivery of  the goods stated in the shop web interface applies only where the goods are delivered within the  territory of the Czech Republic.

3. To order goods, the buyer fills in the order form in the shop web interface.  The order form contains in particular information on: the goods being ordered (the buyer  “places” the ordered goods in the electronic shopping cart of the shop web interface),  the method of payment of the purchase price, details of the requested method of  delivery of the ordered goods and information on the costs associated with delivery of the  goods (hereinafter jointly the “order”).

4. When ordering the “Tailor-made dog food” product, the buyer fills in a form  containing specific details that the seller will use to prepare the “Tailor-made dog food”  according to the buyer’s personal requirements.

5. Before sending the order to the seller, the buyer is able to check and change  the details entered in the order, including the possibility of identifying and  correcting errors made when entering data into the order. The buyer sends the order  to the seller by clicking the “Pay” button. The details stated in the order are  deemed correct by the seller. Immediately after receiving the order, the  seller will confirm its receipt to the buyer at the buyer’s e-mail address stated in  the user interface or in the order (hereinafter the “buyer’s electronic address”).

6. Depending on the nature of the order (quantity of goods, amount of the purchase price,  estimated transport costs), the seller is always entitled to ask the buyer for additional  confirmation of the order (for example in writing or by telephone).

7. The buyer’s order constitutes a proposal to conclude a purchase contract, and the purchase  contract itself is concluded at the moment the binding acceptance of this proposal by both the  buyer and the seller is delivered (the binding confirmation of the order by the seller). From this  moment, mutual rights and obligations arise between the buyer and the seller.

8. By concluding the purchase contract, the buyer confirms that they have read these  Terms and Conditions, including the complaint terms, and that they agree with them. The buyer  is sufficiently made aware of these Terms and Conditions and the Complaints Procedure  before actually placing the order and has the opportunity to read them.

9. All orders accepted by this shop are binding. An order may be cancelled before it  is dispatched. You can send a cancellation by e-mail or make it by telephone. When cancelling  an order, you must state your name, e-mail and order number. The buyer is automatically  informed of the acceptance of the order by e-mail.

10. If an item of goods comes in several variants (colours, patterns, …) and it is not  possible to choose the desired variant directly in the e-shop offer, this can only be done  individually by telephone or e-mail arrangement, but always before the order itself is  concluded. As all orders are automatically forwarded to the warehouse immediately and  then dispatched, special requests regarding colour and pattern cannot be guaranteed or  accommodated if the request is stated only in the order comment. This is possible only before

the order is concluded and after prior agreement via our customer line or by e-mail.

11. The buyer acknowledges that the seller is not obliged to conclude a purchase contract,  in particular with persons who have previously materially breached a purchase contract (including  the Terms and Conditions).

12. The buyer consents to the use of means of distance communication when concluding the  purchase contract. Costs incurred by the buyer when using means of distance communication  in connection with the conclusion of the purchase contract (costs of internet connection,  costs of telephone calls) are borne by the buyer.

IV. PRICE OF GOODS AND PAYMENT TERMS

1. The buyer shall pay the seller the price of the goods under the purchase contract and  any costs associated with delivery of the goods by cashless payment via the GoPay payment gateway, or by means of a valid voucher as specified in Article VIII of these Terms  and Conditions. The stated payment methods may be combined.

2. Together with the purchase price, the buyer is obliged to pay the seller any costs associated with  packaging and delivery of the goods in the agreed amount, the exact amount of which depends on the  method of delivery of the goods chosen by the buyer and on the method of payment of the purchase price  chosen by the buyer, and which is communicated to the buyer no later than before the order is sent.

3. Except for the provision of paragraph 6 of this Article of the Terms and Conditions regarding the  obligation to pay an advance on the goods up to the amount of the purchase price in advance, the seller does not  require an advance or any other similar payment from the buyer.

4. The purchase price is payable upon completion of the order. The buyer’s obligation to pay the purchase price is fulfilled at the moment the relevant amount is credited to the seller’s account  under the correct variable symbol.

5. Where cashless payment of the purchase price is chosen, the seller is not obliged to deliver  the goods before the full purchase price has been paid. In cases where the seller is entitled  to request additional confirmation of the order from the buyer, the seller is entitled to  request payment of an advance on the goods of up to the full purchase price before the goods are  dispatched to the buyer, regardless of the delivery method chosen by the buyer. In such a case, the seller  is therefore not obliged to deliver the goods before the advance has been paid.

6. Prices of goods remain valid for as long as they are displayed in the shop web interface.  This does not limit the seller’s ability to conclude a purchase contract on  individually agreed terms. The seller may offer a discount on the purchase price, among other  things, by means of a discount code. Any discounts on the price of goods granted by the  seller to the buyer cannot be combined with each other.

7. If customary in business dealings or if so required by generally binding legal regulations,  the seller will issue the buyer a tax document – invoice – for payments made under  the purchase contract. The seller is a value added tax payer. The seller will issue the tax  document – invoice – to the buyer after the price of the goods has been paid and will deliver  it to the buyer physically together with the ordered goods.

8. EET INFORMATION NOTICE: under Act No. 112/2016 Coll., on Registration of Sales, the seller  is obliged to issue the buyer a receipt. At the same time, the seller is obliged to register the received  sale with the tax administrator online; in the event of a technical outage, within 48 hours at the latest.

V. DELIVERY OF GOODS, HANDOVER AND ACCEPTANCE OF GOODS

1. The seller fulfils its obligation to hand over the goods to the buyer if it enables the buyer to  dispose of the goods at the place of performance and notifies the buyer of this within the delivery period by  e-mail to the buyer’s e-mail address stated in the ordering process, in the registration of the user account  or otherwise communicated by the buyer. The delivery period is 14 working days from the  seller’s receipt of the order, or 14 working days from payment of the purchase price if it is to be paid before  the goods are handed over.

2. The place of performance is the place stated by the buyer in the order as the place to which the  goods are to be sent (place of destination). If the seller is to dispatch the goods, the seller hands  over the goods to the buyer by handing them over to the carrier performing the transport; this does  not apply if the carrier was designated by the buyer without being offered by the seller – in such  a case the goods are handed over by the seller to the buyer by handing them over to the first  carrier for transport for the buyer, while the buyer is at the same time enabled to exercise rights  against the carrier.

3. Delivery costs, as well as any costs associated with packaging the goods, are agreed at the time  the goods are ordered; the prices are stated in the order and in the confirmation of receipt  of the order sent to the buyer, and are payable together with the purchase price.

4. If the method of transport or the carrier performing the transport is agreed on the basis  of a special request of the buyer, the buyer bears the risk of damage to the goods during transport  and any additional costs associated with this method of transport.

5. Unless it has been agreed how the goods are to be packed, the seller packs the goods in accordance with  customary practice; if there is none, in a manner necessary to preserve and protect the goods.  The seller prepares the goods for transport in the same manner.

6. When taking over the goods from the carrier, the buyer is obliged to check that the packaging  of the goods is intact and to notify the carrier immediately of any defects. If the packaging is found  to be damaged in a way indicating unauthorised entry into the consignment, the buyer does not have to  accept the consignment from the carrier. If the buyer nevertheless accepts the damaged consignment,  the buyer is obliged to describe the defect(s) in the consignment acceptance report; otherwise the buyer  cannot claim damage to the consignment that occurred during transport.

7. If the seller is obliged under the contract to deliver the goods to the place specified by the  buyer in the order, the buyer is obliged to accept the goods upon delivery.

8. If, for reasons on the buyer’s side, the goods have to be delivered repeatedly or in  a manner other than that stated in the order, the buyer is obliged to pay the costs associated  with the repeated delivery of the goods, or the costs associated with the other method  of delivery.

9. Other rights and obligations of the parties in the transport of goods may be governed by the  seller’s special delivery terms, if issued by the seller, and by the Complaints Procedure.

VI. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE

1. The seller shall hand over the subject of purchase to the buyer in the agreed quantity, quality and  design. If quality and design have not been agreed, the seller shall perform in a quality and design suitable  for the purpose apparent from the contract, or otherwise for the usual purpose. If the seller delivers  a larger quantity of goods than agreed, the purchase contract is concluded for the excess quantity as well,  unless the buyer has rejected it without undue delay.

2. The rights and obligations of the contracting parties regarding rights arising from defective performance,  including the quality guarantee, are governed by the relevant generally binding legal regulations (in particular  Sections 1914 to 1925, Sections 2095 to 2117 and Sections 2161 to 2174 of the Civil Code).

3. At the Buyer’s request, the Seller will confirm in writing the scope and duration of the Seller’s  obligations in the event of defective performance (hereinafter the “confirmation”). In  the confirmation, the Seller will also state its name, registered office and identification details.  If the nature of the item does not prevent it, the confirmation may be replaced by a proof  of purchase containing the above details.

4. The buyer is entitled to exercise the right arising from a defect that occurs in consumer goods within  twenty-four months of taking delivery. In the case of the purchase of used consumer goods, the buyer  is entitled to exercise the right arising from a defect that occurs in the goods within twelve months.  If the period for which the item may be used is stated on the item sold, on its packaging, in the  instructions attached to the item or in advertising in accordance with other legal regulations, the provisions  of the Civil Code on the quality guarantee apply. The period for exercising rights arising from  defective performance starts on the day the goods are taken over.

5. The seller is liable to the buyer that the goods have no defects upon acceptance. In particular, the  seller is liable to the buyer that, at the time the buyer took over the goods:

• the goods have the properties agreed by the parties and, in the absence of such an agreement, the properties  described by the seller or manufacturer or expected by the buyer with regard to the nature of  the goods and on the basis of advertising carried out by them,

• the goods are fit for the purpose stated by the seller for their use or for  which goods of this kind are usually used,

• the goods correspond in quality or design to the agreed sample or model, if the  quality or design was determined according to an agreed sample or model, • the goods are in the appropriate quantity, measure or weight, and

• the goods comply with the requirements of legal regulations.

6. The following do not constitute a defect of the goods:

• damage to the goods resulting from improper installation, operation, modifications  or repairs, from inappropriate handling of the goods, gross neglect of care for the  goods, use contrary to the manufacturer’s recommendations, instructions or user manual,  or from other unprofessional interventions, except where such damage was caused by  the seller itself;

• damage to the goods resulting from the use of incorrect consumables; • damage to the goods resulting from exceeding the service life of the goods; • mechanical damage to the goods;

• damage to the goods resulting from use or storage of the goods in an unsuitable environment,  in conditions whose temperature, dust, humidity or chemical and mechanical influences do  not correspond to the properties of the goods;

• damage to the goods resulting from a natural disaster or force majeure.

7. The seller’s liability for defects of the goods is excluded for goods sold at a lower price  in respect of the defect for which the lower price was agreed, for wear and tear of the goods caused  by their normal use, for used goods in respect of a defect corresponding to the degree of use  or wear the goods had when taken over by the buyer, or where this follows from the nature of the goods.

8. The buyer’s right arising from defective performance is based on a defect that the goods have when the  risk of damage passes to the buyer, even if it only becomes apparent later. If a defect becomes apparent within six  months of acceptance, the goods are deemed to have been defective at the time of acceptance. The buyer’s right is also  established by a defect arising later that was caused by the seller’s breach of its obligations.

9. The moment of making a complaint is deemed to be the moment at which the seller is notified of the occurrence of  the defect and the right arising from defective performance of the purchased goods is exercised.

10. The buyer shall inspect the goods as soon as possible after the risk of damage to the goods  has passed and satisfy themselves of their properties and quantity. If the seller dispatches the goods,  the buyer may postpone the inspection until the goods have been transported to the place of  destination. If, after unpacking the consignment, the buyer finds that the contents were damaged during  transport, the buyer shall notify the seller of this fact no later than three working days after  taking over the goods, using the contacts provided at the web address www.rawbark.cz.

11. The buyer exercises rights arising from defective performance with the seller via the  contacts provided at the web address www.rawbark.cz.

12. Rights arising from liability for defects: If the item does not have the properties set out in paragraph 5 of this Article of the Terms and Conditions, the buyer may also demand delivery of new goods without defects, unless  this is disproportionate given the nature of the defect; however, if the defect concerns only a part of the goods,  the buyer may only demand replacement of that part; if this is not possible, the buyer may withdraw from the  contract. If, however, this is disproportionate given the nature of the defect, in particular if the defect can be removed

without undue delay, the buyer has the right to have the defect removed free of charge. The  buyer also has the right to delivery of new goods or replacement of a part in the case of a removable  defect if the buyer cannot use the goods properly due to the repeated occurrence of the defect after  repair or due to a larger number of defects. In such a case the buyer also has the right to withdraw from  the contract. If the buyer does not withdraw from the contract or does not exercise the right to delivery  of new goods without defects, replacement of a part or repair of the goods, the buyer may demand  a reasonable discount. The buyer is also entitled to a reasonable discount if the seller cannot deliver  new goods without defects, replace a part or repair the goods, as well as if the seller fails to remedy  the situation within a reasonable time or if remedying the situation would cause the buyer considerable  difficulties. The buyer is also entitled to delivery of missing goods or a part thereof.

13. The buyer is not entitled to rights arising from defective performance if the buyer knew before taking  over the goods that the goods had a defect, or if the buyer caused the defect themselves, or if it  is a defect that the buyer must have recognised, exercising ordinary care, already when concluding the  purchase contract and did not notify the seller of it in the manner set out in the Complaints Procedure  without delay after concluding the contract, at the latest within three working days after the item was  delivered to the place of destination, if the goods are transported to the buyer by a carrier.

14. The right to exercise rights arising from liability for defects of the goods expires:

• if the right arising from the defect was not exercised within the period for exercising rights arising from defective performance; • in the event of any changes made by the buyer to the original details in the confirmation; • if protective stickers or seals have been broken, where the manufacturer has fitted the product with them.

15. The seller provides a quality guarantee only where the period for which the item may be used  is stated on the goods sold, on their packaging, in the instructions attached to the goods  or in advertising in accordance with other legal regulations. In such a case the guarantee period  starts on the day the buyer takes over the goods. The guarantee period is extended by the period  during which the Buyer could not use the goods due to their repair under guarantee.

16. The rules of the complaints procedure are set out in detail in the Complaints Procedure of the seller, both where  rights arising from defective performance are exercised and where rights under the quality guarantee  are exercised.

VII. CONSUMER’S RIGHT TO WITHDRAW FROM THE CONTRACT

1. For the avoidance of any doubt, the seller declares that, within the online sales  provided on the website, it does not provide any services, including repair  or maintenance services, accommodation, transport or catering services, and does not  supply alcoholic beverages, audio or video recordings or computer programs, newspapers,  periodicals or magazines, or digital content.

2. The buyer acknowledges that, pursuant to Section 1837 of the Civil Code, it is not possible, among  other things, to withdraw from a purchase contract for the supply of goods that have been customised  according to the buyer’s wishes or for the buyer personally, from a purchase contract for the supply of goods that  are subject to rapid deterioration, as well as goods that have been irreversibly mixed with other goods after  delivery, from a purchase contract for the supply of goods in sealed packaging which the consumer has  removed from the packaging and which cannot be returned for hygiene reasons, and from a purchase contract for  the supply of an audio or video recording or computer program if the original packaging has been broken.

3. Unless it is a case referred to in paragraph 2 of this Article of the Terms and Conditions,  the buyer has the right, in accordance with Section 1829(1) of the Civil Code, to withdraw from  the purchase contract within fourteen (14) days of taking over the goods; where the subject of the  purchase contract is several types of goods or the delivery of several parts, this period runs from  the day of taking over the last delivery of goods. The withdrawal from the purchase contract must be  sent to the seller within the period stated in the previous sentence.

4. In the event of withdrawal from the purchase contract pursuant to paragraph 3 of this Article  of the Terms and Conditions, the purchase contract is cancelled from the outset. The goods must  be returned to the seller without undue delay, no later than fourteen (14) days after withdrawal  from the contract. If the buyer withdraws from the purchase contract, the buyer bears the costs  associated with returning the goods to the seller, even if the goods cannot be returned by  the usual postal route due to their nature.

5. In the event of withdrawal from the contract pursuant to paragraph 3 of this Article of the Terms  and Conditions, the seller will return the funds received from the buyer, including the costs of delivery of the  goods, within fourteen (14) days of the day the goods are returned or it is proven that the goods have been sent,  in the same manner in which the seller received them from the buyer. If the buyer chose a method of delivery other

than the cheapest method of delivery offered by the seller, the seller will refund  the buyer the costs of delivery of the goods in the amount corresponding to the cheapest  method of delivery offered. The seller is also entitled to return the performance provided by the  buyer already when the buyer returns the goods or in another manner, including by set-off against  a new invoice (purchase price) in the case of a further purchase from the seller, provided the  buyer agrees and no additional costs are incurred by the buyer. If the buyer withdraws from the  purchase contract, the seller is not obliged to return the received funds to the buyer before the  buyer returns the goods or proves that the goods have been sent to the seller.

6. The buyer is liable to the seller for any reduction in the value of the goods resulting  from handling the goods in a manner other than necessary with regard to their nature and properties.  The seller is entitled to unilaterally set off the claim for compensation for damage to the  goods against the buyer’s claim for a refund of the purchase price.

7. If a gift is provided to the buyer together with the goods, the gift contract between  the seller and the buyer is concluded subject to a condition subsequent that, if the buyer  withdraws from the purchase contract, the gift contract regarding such a gift ceases to  have effect and the buyer is obliged to return the gift provided to the seller together with the goods.

VIII. VOUCHERS

1. A voucher is a document issued by the seller in paper or electronic form which  entitles its holder to full or partial payment of the purchase price for the seller’s goods  up to the nominal value of the voucher. The voucher contains in particular details of the seller, the nominal value of the voucher, the expiry date of the voucher and a unique numerical code  of the voucher for redemption on the seller’s website. A voucher can only be redeemed  once; upon redemption the voucher ceases to exist.

2. The voucher holder is obliged to use up the value of the voucher by purchasing goods from the seller.  The voucher holder is not entitled to exchange the voucher for cash. Prices of goods may change  during the validity of the voucher. If the nominal value of the voucher exceeds the value  of the goods purchased, the customer is not entitled to a refund of the amount representing the difference between  the nominal value of the voucher and the value of the goods purchased.

3. The voucher holder is obliged to redeem the voucher during its period of validity. After the voucher has expired,  the holder can no longer redeem it. The validity of the voucher may be  extended by the seller.

4. If the purchase contract under which the purchase  price was paid by means of a voucher is cancelled within the meaning of Art. VII of the Terms and Conditions, the voucher will be returned to the holder – customer in the value of that voucher. The returned voucher in its current  value may be used again from the day the contract is cancelled, of which the customer will be  informed by the seller. The validity period of the voucher is not affected by its return,  i.e. the voucher may be used no later than the expiry of the date originally  stated on the voucher.

IX. PERSONAL DATA PROTECTION

1. The protection of personal data, including the processing of personal  data for marketing purposes, the sending of commercial communications and cookies, is

dealt with in a separate section entitled “Privacy Policy”. Supervision in the area of personal  data protection is exercised by Úřad pro ochranu osobních údajů (Office for Personal Data Protection), with  its registered office at Pplk. Sochora 727/27, 170 00 Praha 7 – Holešovice, web: www.uoou.cz.

X. DELIVERY OF DOCUMENTS

1. Documents may also be delivered to the buyer by e-mail to the buyer’s  electronic address provided in the process of concluding the purchase contract, in the  process of creating the user account, or in other mutual communication. Documents  delivered in this way are deemed delivered no later than on the third calendar day after  they were sent.

XI. OTHER ARRANGEMENTS

  1. The web interface operated by the seller contains an “Advice” section (Poradna). By submitting a question to this section, the visitor to the web interface agrees to its publication in the relevant section. By submitting a question, the visitor also acknowledges that any response from the seller to their question is based solely on the seller’s experience, is not the opinion of an expert or veterinarian, and the seller is not liable for any harm suffered by the visitor.
  2. The buyer agrees that all photographs provided to the seller via the web interface, e-mail or otherwise may be used by the seller for marketing purposes.

XII. FINAL PROVISIONS

1. The seller handles out-of-court consumer complaints via the electronic address  info@rawbark.cz. The seller will send information on the handling of the buyer’s complaint to the  buyer’s e-mail address provided by the buyer in the process of concluding the purchase  contract or creating the user account, or to the e-mail address stated in the complaint if it  differs from the address provided by the buyer when concluding the purchase contract.

2. The seller is authorised to sell goods on the basis of a trade licence. Trade  inspection is carried out within its competence by the relevant trade licensing office. Česká  obchodní inspekce (Czech Trade Inspection Authority) supervises, within a defined  scope and among other things, compliance with Act No. 634/1992 Coll., on Consumer Protection,  as amended.

3. INFORMATION ON THE POSSIBILITY OF OUT-OF-COURT RESOLUTION OF  CONSUMER DISPUTES: If a consumer dispute arises between the seller and a consumer  under the purchase contract that cannot be resolved by mutual agreement, the consumer has the right,  in accordance with Section 20d et seq. of Act No. 634/1992 Coll., on Consumer Protection, as amended,  to out-of-court resolution of the consumer dispute, i.e. may file a petition for out-of-court resolution  of such a dispute with the designated body for out-of-court resolution of consumer  disputes, which is Česká obchodní inspekce (Czech Trade Inspection Authority), Central Inspectorate – ADR Department, Štěpánská 15, 120 00 Praha 2, e-mail: adr@coi.cz, web: adr.coi.cz.  All details on out-of-court resolution are available on the website of the Czech Trade  Inspection Authority www.coi.cz

4. The consumer may also use the online dispute resolution platform set up by  the European Commission at http://ec.europa.eu/consumers/odr/

5. If the relationship established by the purchase contract contains an international (foreign)  element, the parties agree that the relationship is governed by Czech law. This does not  affect the consumer’s rights arising from generally binding legal regulations.

6. If any provision of the Terms and Conditions is or becomes invalid or ineffective,  the invalid provision will be replaced by a provision whose meaning comes as close as  possible to the invalid provision. The invalidity or ineffectiveness of one provision does not  affect the validity of the other provisions.

7. The buyer is obliged to read these Terms and Conditions before purchasing goods.  By sending the order to the seller, the buyer confirms that they have read these Terms  and Conditions and the Complaints Procedure, are familiar with their content and  expressly agree with their wording. The Terms and Conditions are available as a document  at www.rawbark.cz

This version of the Terms and Conditions is valid and effective from 3 December 2020.
